1. Identification data

2. Legislation and jurisdiction

These general terms and conditions shall be interpreted in accordance with the legislation in force in Spain on the subject, which shall be applied subsidiarily in all matters not provided for in these terms and conditions. (Law 34/2002 of 11 July 2002 on information services and electronic commerce).

3. Methods of payment

To purchase it is necessary to add each of the items you want to the “shopping cart”.
To make the payment, it is very important that you fill in the proposed form with all the required data. Then you must click on the “Checkout” button.
You can pay by credit card: the payment information will be sent by means of an advanced encryption system that will guarantee the confidentiality of the operation.

3.1 Payment by VISA or MASTERCARD credit card

We guarantee that every transaction is secure. All operations involving the transmission of personal or banking data are carried out using a secure environment. Likewise, your credit card details are not recorded in any database but go directly to the bank’s POS (Point of Sale Terminal).
In both cases, when paying by VISA or MASTERCARD you will always be asked for the following information: the card number, the expiry date, and a Validation Code that coincides with the last 3 digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering more guarantees about the security of the transaction.

3.2 Payment by bank transfer

You can also pay by bank transfer, the payment details will appear at the end of the purchase process.

4. Prices and validity period of the offers

The prices indicated below each product are total prices (excluding VAT) to which shipping costs for each destination must be added. The prices are shown in euros. The prices and conditions shown are valid at all times, and are valid only during the open session. In the order confirmation information, prior to the buyer’s acceptance of the transaction, the prices of each of the items chosen are clearly specified, along with the delivery costs that will be applicable to the transaction and any promotions or discounts that may be applicable.

The prices shown may be revised and modified if conditions so require at any time.
If there is a typographical error in any of the prices shown and a customer has made a purchase at any of the prices shown, the prices shown may be revised and modified at any time.
If there is a typographical error in any of the prices shown and a customer has made a purchase decision based on this error, we will inform the customer of this error and the customer will have the right to cancel the purchase without any cost on their part.

5. Stocks of articles

The availability of each product is indicated on the product sheet. If when searching for one of our products the web informs you that we do not have the article you want, you can contact us to order it.

If the product is definitely out of stock, we can advise you on how to select another article that fulfils the same functions and meets your needs.

Although we always check our stock, exceptionally it may happen that a product is out of stock at a certain time. If this happens after your request and one of the items you order is out of stock, we will contact you to offer you a solution. If you decide that without that product you are not interested in the rest of the purchase, we will proceed to cancel the shipment and refund your money. If you prefer to wait, we will send you the rest of the items you have ordered and when we have it we will send it to you, in this case the costs of this second shipment will be paid by us. If the item is definitely out of stock, we will refund you the full amount.

The images of the products may not coincide with the product delivered.

6. Transport

Orders will be delivered by a transport agency. The orders will be delivered to the address designated by the buyer, therefore Caldeu assumes no responsibility when delivery cannot be made as a result of the data provided being inaccurate or incomplete or when delivery cannot be made due to the absence of the addressee. If the addressee is absent, the transport agency will try to make the delivery again as soon as possible, and in case of failure of delivery, the package will be returned to us. In this case, the customer will be refunded the money paid for the products but not for the transport.

Delivery times are calculated in working days, and may be altered by local or national holidays. On Saturdays, Sundays and public holidays there is no collection or delivery service for orders, a circumstance that must be taken into account when calculating delivery dates. In periods when special circumstances arise (special dates such as Christmas, transport strikes, extraordinary events, etc.), deliveries may be delayed.

Deliveries at specific and concrete times are not guaranteed. If the buyer indicates a specific delivery date, or within it, shows a preference for a specific time slot, it will be understood that he/she does so as a guideline.

Caldeu must inform the carrier of this circumstance so that, as far as possible, it complies with this indication, without assuming any other obligation or responsibility.

6.1 Transport prices

The price of the product and the price of transport are always listed separately.
The rates are calculated by weight of the items to be shipped.

In the case of shipments to Ceuta and Melilla, the Canary Islands and Andorra, please note that the shipping costs only include the export costs (DUA). The import costs (DUA) and possible taxes will always be paid at destination by the receiver of the goods.

7. Legal age of users

In order to use the services of our website, you must be of legal age. By accessing our website, the user declares to be of legal age in his/her country.

The user is solely responsible for knowing the regulations on the sale of alcoholic beverages in their country. In Spain, the user must be over 18 years of age. Caldeu reminds you that alcohol abuse is dangerous for your health and recommends you to consume it in moderation.

8. Returns

If for any reason you are not satisfied with your order, you have a period of 30 working days, counting from the date of delivery of the order, to return the unused product to us and exchange it for another product or for a refund (According to art. 44 of Law 7/1996, of January 15, 1996 on the Regulation of Retail Trade modified by Law 47/2002, of December 19, 2002).

Every customer has the right of withdrawal without the need for justification as long as he/she makes use of this right within 30 calendar days from the date of delivery of the order, as communicated by the transport agency, or from the return of the order to the transport agency in the event of failed delivery or repeated absence. The right of return due to withdrawal cannot be exercised when there are indications that the products have been opened, manipulated or exposed to unsuitable conditions. And it is mandatory to return the entire shipment in this case, with all products properly protected, in their original packaging and in perfect condition for subsequent sale.

It is very important that you return the product(s) for exchange or return perfectly packed, and with the corresponding delivery note. If the products are damaged due to improper packaging, we will not accept the return. Except for manufacturing defects, we will not accept exchanges or returns on products that have already been used.

Caldeu undertakes to replace any product not received or received damaged during transport as long as the claim is made within the period and conditions set out above. If it is not possible to replace the product with the same product, the customer may choose another product of similar price or request a refund of the amount paid for it.

Once cancelled, Caldeu undertakes to reimburse the full amount paid within a maximum period of 7 calendar days. For this purpose, the same method used for payment will always be used, except in the case of payments by transfer to bank accounts belonging to a non-EU country, in which case the customer may choose between (1) accepting the repercussion of any commission that may be generated by transfers to accounts in countries that are not members of the European Economic Area, (2) providing another alternative method, whether it be a Pay account or a bank card.

In the case of refunds to bank accounts or cards in countries with a currency other than the euro, given that the amount to be refunded will be in euros – as was the payment – and in order to avoid unnecessary commissions, the customer may also request to leave the amount as a credit for a future purchase.

The customer is also entitled to return a defective product, whether the defect affects its contents (corked wine or other defect) or its exterior (damage to labels, capsules or other decorative elements). In the case of damage to the exterior, the customer must notify the problem within a maximum period of 30 days from the date of delivery of the order and initially submit a photograph showing the problem; for wines with a defect, the period is one year and, when notifying the complaint, the customer must indicate the batch code of the bottle, usually indicated on the back label. Both problems must be communicated, within the aforementioned deadlines, by e-mail to the Customer Service Department, who will inform the customer as soon as possible, and always within 3 working days, whether or not the products will be collected, either to verify the defect or to present it to the producer for analysis or complaint. Until a reply is received, the customer must keep the bottle, with a minimum of 3/4 of its contents and capped with its original cork in the event that it has been opened. Whether it is collected or not, the customer will receive a credit note for the amount paid for the product, excluding postage. If the product is collected, the customer must fill in the Return Form and facilitate collection, which may take place at the same address as the delivery address or at another address if this has been agreed in writing with the Caldeu Customer Service Department.

To return the material, remember to send the complete product in its original packaging.

Once we receive the goods in our warehouses and check that all the above conditions are met, we will proceed to refund the amount in accordance with the method of payment made, and, where appropriate, to send the new product.

If you paid by credit card, the amount will be credited to the same credit card.

You will receive a refund within a maximum of 20 days from receipt of the returned or exchanged product in our warehouse. Please note that when paying by credit card it is likely that your bank will not show the refund amount in your credit balance until the following month.
